James is an intravenous drug abuser, especially opiates. One day, he trips on curb and fractures his left elbow severely. He sees Mr. Smith, the ED physician assistant. Mr. Smith clearly sees the track marks on James’ hands and antecubital areas, plus James does not deny his recreational abuse. However, James has a severe elbow fracture and is in excruciating pain. Mr. Smith writes him for #10 Percocet 5/325. After splinting, he is discharged with a follow up appointment with the orthopedist the next day. James doesn’t go for follow up. Two days later he crushes the Percocet given him by Mr. Smith, and injects himself. He becomes very stuporous and confused. He wanders out into the street and is run over by a bus and killed instantly. James’ family is suing Mr. Smith now for wrongful death, stating the Percocet he prescribed resulted in his death. Further Mr. Smith knew of his history of IVDA, yet prescribed it anyway, resulting in his death. The plaintiff attorney presents countless literature articles, indicating how dangerous it is to prescribe medication for someone who has such addictions, and claims Mr. Smith violated the standard of care.
